VEHICLE PARKING RULES & SPEED LIMIT

Effective May 5, 1999

1. SPEED LIMIT IN THE COURTYARDS
    The maximum speed limit is fifteen (15) miles per hour on all streets.

2. ALL STREETS, EXCEPT AS OTHERWISE PROVIDED FOR HEREIN.
    Parking is reserved for use by the following only:
    a) Automobiles of occupants of Units, while being loaded, or unloaded, for a period of time not exceeding 30 minutes.
    b) Automobiles of short term visitors and house guests that cannot be accommodated in the Units' two garages (when both are reserved for parking), and driveway. However, NO ALL DAY, OR OVERNIGHT PARKING IS PERMITTED BY VISITORS, OR HOUSE GUESTS who should be asked to park in the:
      i) Recessed Parking Areas,
      ii) right side of Cul De Sac ends,
      iii) left side of the street leading to the Swimming Pool,
      iv) or the parking spaces near the Swimming Pool.
   c) Service vehicles, while providing services.
   d) Occupants of Units are not to park their automobiles on streets in front of their houses, except as provided for in (a) above. They are to park in their garages and driveways. (GARAGE DOORS MUST BE CLOSED AT ALL TIMES, EXCEPT WHEN VEHICLES ARE ENTERING OR LEAVING GARAGES.) A particular blockage problem exists when vehicles are improperly parked on Bainbridge Way, Kingsland Court and Yale Court, which have houses on both sides of the streets.
Parking on these streets creates a nuisance and causes serious maneuvering problems for across-the-street neighbors when they are trying to enter or exit their driveways. Additionally, street parking blocks passage of large trucks, fire trucks, etc., causing damaged curbs which are costly to repair.

3. RIGHT HAND SIDES OF CIRCULAR CUL DE SAC ENDS OF COURTYARD DRIVE AND KINGSLAND COURT.
   Parking is allowed in the Marked Parking Spaces only, which are reserved for the following:
   a) Automobiles of temporary visitors and house guests that cannot be accommodated in the Unit's two garages (when both are reserved for parking) and driveway; for short term, all day and overnight parking.
   b) Service vehicles while providing services.
   c) Occupants of Units who have three vehicles, one of which cannot be accommodated in the Unit's driveway because of its limited dimensions. IF OCCUPANTS OF UNITS HAVE MORE THAN ONE VEHICLE THAT CANNOT BE ACCOMMODATED IN THE UNIT'S DRIVEWAY BECAUSE OF ITS LIMITED DIMENSIONS, SUCH MUST BE PARKED ON THE LEFT HAND SIDE OF THE STREET HEADED TOWARDS THE SWIMMING POOL, OR THE PARKING SPACES NEAR THE SWIMMING POOL. No cars can be stored at pool area. The pool area parking is intended as temporary parking only.
Note: The reason that no parking is allowed, except as shown for the Marked Parking Spaces, is to enable large trucks and other vehicles to back into unoccupied curb areas to turn and exit the premises.

4. RECESSED PARKING AREAS ON YALE COURT AND COURTYARD DRIVE
(NEAR JUNCTION WITH KINGSLAND COURT).

   Parking is reserved for use by the following:
   a) Automobiles of temporary visitors and house guests for short term, all day and overnight parking.
   b) Service vehicles while providing services.
   c) These two recessed parking areas are COMMON PROPERTY (4 spaces on Courtyard Drive and 2 spaces on Yale Court), intended for off-the-street parking of AUTOMOBILES ONLY, BY NON-RESIDENTS OF THE COMMUNITY, and are not to be used for regular parking by any resident of the Community.

5. LEFT-HAND SIDE OF STREET HEADED TOWARD THE SWIMMING POOL
AND TENNIS COURT, AND PARKING SPACES NEAR THE SWIMMING POOL

   Parking is reserved for use by the following:
   a) Automobiles of users of Swimming Pool and Tennis Court.
   b) Automobiles of residents of Units who have three or more vehicles, all of which cannot be accommodated in their two garages and driveways.
    *These extra vehicles must be vehicles that are constantly driven. At no time can any of the extra vehicles be "stored" at the swimming pool area.
   c) Automobiles of temporary visitors and house guests for short term, all day and/or overnight parking
   d) Service vehicles while providing services.

6. APSLEY COURT, WAVERLY COURT AND MARKHAM WAY RECESSED PARKING AREAS
   Parking is reserved for use by the following:
  This is private property of Owners of Units on these streets and is reserved for their use subject to the provisions of paragraph 7 herein.

7. AUTOMOBILE PARKING ONLY IN THE COMMUNITY.
  Residents' boats, trailers, campers, trucks, vans, motorcycles and recreational vehicles must be parked in garages at all times and not on driveways or other areas in public view in the Community.

8. PURPOSE OF PARKING RULES
  a) Safety and preservation of property.
  b) Making The Courtyards a better place to live, courteous treatment of neighbors, and enhancing the value of homes.
  c) Designating alternate use, for AUTOMOBILE parking only, of Cul De Sac ends, Recessed Parking Areas, the street serving the Swimming Pool and the parking spaces near the Swimming Pool.
  d) Elimination of the nuisance and inconvenience to those who are having ingress and egress to their garages blocked, or seriously hampered by across-the-street and other improper parking.

9. AUTHORITY FOR ENFORCEMENT OF PARKING RULES.
  a) Article VI, Section 1, General, and Section Parking, of the Declaration, empowers the Board of Directors to establish and enforce vehicular parking rules in the Community.
  b) Article XIV, Section 1 Enforcement, of the Declaration, empowers the Board to levy fines for violations of rules.
  c) Article IV, Section 2, Creation of the Lien and Personal Obligation for Assessments, of the Declaration, provides that fines will be added to Monthly Assessments and will become a lien on the Unit.
  d) Article XII, Section 2a, Compliance With Declaration, By-Laws, and Rules and Regulations (by Lessees), of the Declaration, reads in part as follows: "Lessee shall comply strictly with all provisions of this Declaration, the By-Laws, and the administrative rules and regulations adopted pursuant thereto as any of the foregoing may be amended from time to time."

10. PARKING VIOLATIONS/OPEN GARAGE DOORS - FINES AND TOWING
  a) First Violation: Warning
  b) Second Violation: Warning
  c) Third Violation:
        OPTION ONE: $50.00 ONE-TIME FINE - per occurrence for a single infraction, not ongoing
        OPTION TWO: $50.00 PER DAY FINE - For ongoing violations.
  d) Repeated violations of the Parking Rules will result in vehicles being towed to the towing company's parking lot, at owner's expense.
  e) The Association's Management Agent will monitor parking in the Community and add fines to the Monthly Assessments when appropriate; and will arrange for towing of vehicles which are improperly parked.
  f) The fine for violating the SPEED LIMIT OF 15 MPH anywhere in The Courtyards is $20.00 per occurrence.
